How Well Can Mediation Work in a Murder Case?
Wednesday, August, 15, 2012
A man accused of murdering another man in a pharmacy parking lot may have his case decided before he even goes to trial. Lawyers for defendant Robert Hall are seeking mediation before the October 2012 court date.
What are the Murder Accusations?
Robert Hall is accused of murdering attorney Emmett Corrigan in a Walgreen's parking lot in Idaho. The accusation is that Hall shot Corrigan twice, and then shot himself once.
The initial charges were made in March 2011. Since that time, the date for the trial has been changed a number of times.
With over 100 different witnesses (although only one eyewitness) and dozens of different pieces of evidence, the case could take up to three weeks if it goes to trial after mediation.
What Was Hall's Motive and Why Mediation Services?
What was Hall's problem with Corrigan? Was he a former client who didn't like his outcome in court? Was he about to go to court against someone who was represented by Corrigan? Did he simply not like the lawyer's last name?
Hall may have believed that Corrigan was having an affair with Hall's wife, Kandi. He may also have believed that Kandi was going to leave him for the lawyer.
Will Civil Mediation for this Murder Trial Avoid a Court Case?
It remains uncertain as to whether mediation between Hall's and the state's attorneys will keep the case from going to court.
Plea bargains aren't the only thing the attorneys might talk about. They may talk about evidence or other issues.
A trial judge would have to approve any plea bargain or binding agreements reached by the lawyers. It's also possible that one or both sides may simply wish to resolve certain issues before the trial begins.
