Lawsuit Against Uber Heading to Mediation
Uber and the lawyers representing a woman who alleges she was raped in India by a driver employed by Uber will be heading into mediation in an attempt to settle the matter without going to court.
The woman, whose identity remains sealed, alleges that while traveling in Delhi she was sexually assaulted by the driver after she fell asleep in the back seat of the car, and claims Uber was negligent in its hiring and screening practices. The driver was arrested and charged in India.
Uber attempted to have the lawsuit thrown out based on the fact that both the woman and the driver are Indian citizens, making California an inappropriate venue for the suit. Uber also argues that its service constitutes an agreement between three parties, with the passenger and the driver both entering into agreements with Uber. However, the courts have so far upheld the woman’s right to proceed with the lawsuit.
Now both sides have requested the court’s permission to pursue a private mediation. If granted, they would have an unlimited amount of time to attempt a settlement, with the option to pick up the lawsuit if mediation fails. The court is expected to grant the request since it comes from both sides simultaneously.
In India, the criminal case against the driver is ongoing, but is expected to last several months if not longer, as the court system in India is incredibly crowded with cases and one of the most notoriously slow-moving in the world.
