Mediation Fails in Dispute Over Thurmont, MD Historic Building

Friday, January, 22, 2016

A building in Thurmont, Maryland is causing a ruckus between the city’s historical society and a local construction company. The dispute focuses on repairs made to the society’s Creeger House, located on N. Church Street. Following an hours-long court hearing, the judge said he would review the evidence presented and make his decision within a week.

The dispute arose when the construction company completed work on the building’s summer kitchen. Initially, both sides agreed to try mediation to reach a settlement over the dispute, but attempts at doing so failed and the parties were forced to return to court.

The attorney for the construction company argued the builder performed repairs requested by the historical society and deserved to be paid for the work completed. The construction company filed the complaint after work was completed and the society still had not paid by October. The society responded that the repairs did not meet the group’s standards and they would not be paying for the work. Some familiar with the work said the kitchen was in worse condition after the work was done.

The society said the repairs in question included adjustments to the cantilever support and installing a new concrete pad incorrectly. The group plans to fix the work and will need to pay more and take more time on the project. Thurmont has received a $9000 grant from the Maryland Housing and Community Development Legacy Program to pay for the repairs. The construction company offered to bring the repairs up to the expectations of the historical society, but the group refused.
