Survey Reveals What Divorced Couples Regret Most – Seddons, a London law practice, surveyed 867 people who had gone through a divorce or separation and roughly one-third — the largest percentage of respondents — said that their biggest regret about ending their marriage was the effect it had on their children. Seddons carried out the survey in conjunction with the Marriage Foundation, a think tank that aims to reduce divorce rates, established by British High Court judge Sir Paul Coleridge.

14 US Cities With Big Foreclosure Problems – One in every 1,155 U.S. homes received a foreclosure filing in November, according to the latest foreclosure data from RealtyTrac.

Mortgage Applications Fall in Latest Week – The Mortgage Bankers Association said its seasonally adjusted index of mortgage application activity, which includes both refinancing and home purchase demand, fell 5.5 percent to 374.6 in the week ended December 13.

Attorneys, Mediators and Professional Malpractice Claims – What the Numbers ShowProfessional malpractice has become a hot-button issue across many professions, but particularly for lawyers and mediators. On one hand, we see it from the plaintiff’s side—defending victims of wrongdoing from professional misconduct. On the other, we see it from the defendant’s side—as we, ourselves, understand the nuanced fine line between using the law for pursuing justice and abusing that law for pursuing personal greed.

According to the American Bar Association’s profile of legal malpractice claims (2008-2011), the top five problem practice areas related to professional malpractice claims are below:

1. Real Estate (20.33 percent of all claims)

2. Plaintiffs’ Personal Injury (15.59 percent of all claims)

3. Family Law (12.14 percent of all claims)

4. Estates, Trust, and Probate (10.67 percent of all claims)

5. Collection and Bankruptcy (9.20 percent of all claims)

The most recent study, conducted in 2011, was the largest to date, showing data from 53,000 claims submitted by 20 lawyer-owned malpractice insurers and eight commercial malpractice insurers. The most interesting thing to note in the 2011 survey is that for the first time in 27 years (the time span in which the survey has been conducted), personal injury practice is no longer drawing the largest number of claims. What has replaced it is real estate practice—a definitive and telling result of the 2007-2008 housing market meltdown.

The ABA’s report further divides legal malpractice claims into four separate categories: 1) administrative errors, 2) substantive errors, 3) client relations and 4) intentional wrongs. Of these four, substantive errors were the cause of 45.07 percent of the claims filed in 2011 and remain the most significant reason clients file claims against attorneys following legal services rendered. Administrative errors fall at a close second, at 30.13 percent.

The third most reported legal malpractice claim involves client relations errors, which have risen to their 2003 levels at 14.6 percent, despite having fallen significantly in the 2007 study and having peaked (at 18.75 percent) in the 1999 study.

However, the 2011 ABA study does reveal some positive development, particularly in the category of lawyers committing intentional wrongs. This category—although peaking to 13.53 percent in 2007—has decreased significantly to represent the lowest percentage reported in all four categories (10.19 percent in the 2011 survey). This is especially promising, considering that for the most part, these types of errors are those that attorneys can avoid.

Pet Mediation Succeeds Where the Courts Fail

Pet mediation is a powerful and effective alternative to litigating pet-related disputes, and has proven to be useful in resolving conflicts related to a pet’s presence or actions.  Pet owners who encounter conflict related their pet or another’s pet understand first-hand how difficult such conflicts can be.  When litigation is pursued over matters related to a pet, the courts are often unwilling to consider mitigating circumstances that might affect the judge’s decision.  Additionally, often-biased and poorly written laws and statutes that are related to pet ownership and responsibility for a pet’s actions fail to consider circumstances that might be beyond a pet owner’s control.

In much the same way that parents seek the best for their children, responsible and caring pet owners seek the best for their pets.  In fact, many pet owners consider their pets to be as important and loved as children would be, and can become highly emotional when a conflict arises that involves their pet.

In pet mediation, a third-part mediator who is well-versed in laws and regulations related to pet ownership and responsibility will sit down with all parties involved in a pet-related dispute to assist in finding ways to resolve the dispute without taking it through the court system.  Such methods have proven highly successful in helping parties in conflict reach a satisfactory resolution—one that considers the best interests of everyone, including the pet.  In disputes such as these, miscommunication is often a factor; once that miscommunication has been corrected, it is easier for everyone to discuss the best and most logical way to resolve the issue.

Some common disputes dealt with in pet mediation include rental property disputes related to a pet’s presence, problems with a pet’s behavior, veterinary issues, disputes between a breeder and client, disputes between a kennel and client, and problems related to pet sitting and pet care.  In such cases, a pet dispute mediator will hear all evidence or testimony related to the conflict and help the parties involved reach a workable, reasonable agreement without the hassle and cost of taking the dispute to the courts.

Atari’s bankruptcy plan approved by US court – A US Bankruptcy Court judge has approved Atari’s plan to pay back creditors and move out of bankruptcy, The Wall Street Journal reports. The firm filed for Chapter 11 back in January, and a proposal – with agreements from its creditors – will allow the firm to pay what it owes over the course of the next three years.
