PROFESSIONAL BACKGROUND:
Eric van Ginkel is a mediator and arbitrator specialized in
domestic and international commercial dispute resolution. Mr. van Ginkel is an Adjunct Professor of Law
at the Straus Institute for Dispute Resolution of Pepperdine University School of Law, where he has
taught courses in “Alternative Dispute Resolution Survey”, “Arbitration”, “International Commercial
Dispute Resolution”, “International Investment Disputes”, “Introduction to the Legal Process,” and the
“Mediation Clinic” (in alphabetical order). Since 2007, Mr. van Ginkel also teaches a course in Advanced
Mediation at the Law School of City University of Hong Kong. In addition, he is one of the trainers in the
“Mediating the Litigated Case” seminar offered by the Straus Institute as a six-day course.
In 2005, 2006, 2007, 2009 and again in 2010, Los Angeles Magazine and Law and Politics Mediahonored him as one of a small group of "Super Lawyers" in Southern California in the “ADRArbitrator/Mediator” category.
From 1999 until 2006, Mr. van Ginkel was Counsel to the international law firm of Hughes Hubbard &
Reed LLP, in its Los Angeles office, as a member of the Arbitration and Intellectual Property Practice
Groups.
Mr. van Ginkel is a member of the Board of the California Dispute Resolution Council. He is a member of
the Arbitration and Mediation Committees (Co-Editor of the Mediation Newsletter), and a past Senior
Vice-Chair of the Committee on Intellectual Property and Entertainment Law, of the International Bar
Association. He is also a past Chair of the Litigation Section’s ADR Committee of the State Bar of
California. In addition, he is a member of the Los Angeles, Beverly Hills and Orange County Bar
Associations, and the Los Angeles and Orange County chapters of the Association of Business Trial
Lawyers and Federal Bar Association. He is a Fellow of the College of Commercial Arbitrators. Mr. van
Ginkel is a frequent speaker and trainer on subjects involving mediation and arbitration.
ADR TRAINING:
Mr. van Ginkel holds a Certificate in Dispute Resolution and a Master of Laws (LL.M.)
degree in International Dispute Resolution from the Straus Institute for Dispute Resolution at Pepperdine
University School of Law. He is also a graduate of the Harvard Law School Negotiation Project. In
addition, he has attended numerous advanced training programs provided by the Straus Institute, the
American Arbitration Association, the International Centre for Dispute Resolution and the Federal and
State court systems.
ADR EXPERIENCE:
Mr. van Ginkel has acted both as counsel and as arbitrator in numerous
arbitrations. He has mediated more than 350 cases. Mr. van Ginkel is an arbitrator and/or mediator for
the American Arbitration Association (AAA), the Australian Centre for International Commercial Arbitration
(ACICA), the International Institute for Conflict Prevention & Resolution (CPR), the International Chamber
of Commerce (ICC), the International Centre for Dispute Resolution (ICDR), the International Mediation
and Arbitration Center (IMAC), the London Court of International Arbitration (LCIA), the National
Arbitration Forum (NAF) and the World Intellectual Property Organization (WIPO). He serves on the
Panels of the U.S. District Court (Central District of California), the Los Angeles Superior Court and the
California Court of Appeal (Second Division).
With a background in both transactional and litigation law practices, Mr. van Ginkel has been negotiating
complex international and domestic corporate and business transactions for four decades, including joint
ventures, complex bio-technology transactions (including co-development and licensing deals), mergers
and acquisitions, commercial real estate developments (including residential, office and shopping center
developments), straight and syndicated loans, bank and trust matters, and intellectual property related
license and distribution agreements.
He acted as in-house counsel for almost ten years, and in that capacity, supervised the litigation of
numerous court cases in the member countries of the European Union. As mediator for the California
and Federal Courts, Mr. van Ginkel has mediated many tort cases, including automobile accidents, toxic
mold and environmental cases.
