Mediation
Mediation is an attempt to settle a legal dispute through active participation of a third party (mediator), who works to find points of agreement and help those in conflict to reach a fair settlement.
Mediation has become very common in family law and personal injury cases, as well as in construction, business, and property disputes.
Arbitration
Arbitration more closely resembles traditional litigation. An arbitrator hears the evidence and then makes a final, binding decision that is enforceable by the court. One difference between a court judgment and an arbitration decision is that usually arbitration offers no effective appeal process. When the arbitration decision is issued, the case ends.
Mediation-Arbitration
In a mediation-arbitration a third party first acts as a mediator and then, if no agreement is reached, that same person or another person acts as an arbitrator in reaching a decision.
Early Neutral Evaluation
In early neutral evaluation, the disputing parties use an experienced person to hear the evidence and provide an analysis of the strengths and weaknesses of each party’s case. Engaging in this process sometimes helps all parties develop more realistic expectations of the outcome and can assist in achieving an agreement.
