What Is Mediation?

Divorce mediation is not counseling or therapy. It is a process whereby an impartial third party helps a divorcing couple reach an agreement. Divorce mediation can be time-consuming and hard work. However, it is often less costly than a trial and helps to preserve relationships between former spouses — which can be extremely beneficial if children are involved and a post-divorce relationship is necessary. The mediator remains impartial and can offer no legal advice.

No Case Is Too Big or Too Small for Mediation

Mediation may be used to solve all of the issues in a divorce, or it may be used to solve a single issue. Many times, spouses may agree on most issues, but have disputes involving child custody, parenting time and visitation. Florida law allows parties to mediate issues on their own, or under the guidance of an attorney, prior to trial.

Our office can assist in mediations involving various divorce and family law issues, ranging from property division and parenting plans, to financial issues involving child support and alimony/spousal support. We can also assist in mediations involving order modifications.

How Does Mediation Work?

Divorce cases that are not resolved move forward to mediation in an effort to resolve the issues before a trial with the Florida family court judge. The mediator:

  • Is an independent person who helps both parties reach an agreement
  • Helps people understand that they are not as far apart as they think they are
  • Sees through anger and emotions and gets to the key issues
  • Assists parties in coming to an agreement that is acceptable to both

South Florida Lawyer Offering Mediation Services

Each side may be represented by an attorney during the mediation sessions, or the two sides may choose to handle the divorce on their own. Pembroke Pines divorce mediation lawyer Jerome Ventura can provide mediation services in three different ways:

  • As a third-party mediator helping two parties without lawyers reach a pro se divorce settlement
  • As a third-party mediator helping two parties who are each represented by lawyers
  • As an attorney who represents his or her client during the mediation process
